Terms of use

In short

• FlyDown searches for cheap flights for you, and, if you ask, for nearby cities to visit by bus, and alerts you when it finds deals within your budget.
• FlyDown does not sell tickets and is not a travel agency: you always book on the airline's or FlixBus's website.
• Prices are indicative and may change: always check the total before you pay.
• The Basic plan is free. Paid plans cannot be purchased at the moment.

1. Who provides the service

FlyDown is a service operated by Domenico Pasquale, Via Pola 18B, 75012 Bernalda (MT), Italia (VAT no. IT01391390778) ("FlyDown", "we", "us"). Contact: hello@getflydown.com. By using FlyDown you accept these terms; if you do not accept them, do not use the service.

2. What FlyDown does

FlyDown lets you create watches: you choose departure airports, destinations, dates, budget and airlines, and the service checks prices periodically, shows you the deals that match your rules and, if you ask, alerts you with a notification. For the watches where you switch it on, it also suggests itineraries for visiting other cities near your destination, using FlixBus journeys.

Price checks have a minimum interval (currently at most once an hour per watch) and an overall limit, so as not to overload the airlines' websites. When FlyDown is full, a new watch may not be switched on until capacity becomes available: we tell you so in the app.

3. What FlyDown is not

FlyDown is not a travel agency, does not sell tickets, does not receive payments for travel and is not a party to the contract of carriage. When you tap "Book" or a bus journey, you open the website of the airline or of FlixBus: the booking, the final price, baggage, changes, refunds and passenger rights depend solely on that company and its terms and conditions.

4. Prices and information

• Prices, schedules and availability are collected automatically from public sources and from partners and may change at any time, including in the minutes between a check and your booking.
• Unless otherwise stated, the price shown is the base fare per person, without checked baggage or an allocated seat, and may not include charges added by the airline at checkout.
• Multi-city itineraries are calculated automatically. Before booking, check schedules, stops, transfer times from the airport and the margin before your return flight.
• We do our best to keep information correct and up to date, but we cannot guarantee that it is complete or accurate, or that every deal will be found and reported in time. The price that counts is the one you see on the airline's website at the time of payment.

5. Account

• To use FlyDown you must be of legal age and create an account with a valid email address. Each account is personal.
• After you sign up, we send you an email with a link to confirm your address. You can use FlyDown straight away; if you do not confirm within 7 days, your watches are paused until you do. If you forget your password, you can choose a new one using the link we send you by email.
• Keep your password confidential: you are responsible for what happens with your account. If you suspect unauthorised access, change your password and write to us.
• At this stage, sign-up may be restricted to people who have an invite code.
• With the "Invite a friend" link you get one extra active watch for 30 days for each person who signs up through your link and creates their first watch, up to 5 at the same time. When the bonus expires, watches above your plan's limit are paused, starting with the most recent. Accounts created solely to obtain the bonus may be removed.

6. Plans

The Basic plan is free and includes one active watch at a time. The Pro and Unlimited plans are shown with their expected launch prices but cannot be purchased at the moment, and no payment is requested. You can join the waitlist to be notified when they become available: it does not commit you to anything. Before any sale, separate terms of sale will be published, setting out price, duration, renewal, right of withdrawal and how to cancel, which you will have to accept expressly.

We may change the features and limits of the free plan; if a change significantly reduces what you can do, we will tell you in the app with reasonable notice.

7. Acceptable use

FlyDown is for personal use. You may not:

• automatically extract data or prices from FlyDown, resell them or use them for a competing service;
• create multiple accounts or use other tricks to get around plan limits;
• attempt to access other people's accounts, overload the service, circumvent its protections or use it for unlawful activities.

In the event of a breach, we may suspend or close the account, after notifying you where possible.

8. Notifications

Notifications are optional and depend on your device, your browser and third-party notification services (Google, Apple, Mozilla, Microsoft). They may arrive late or not at all: do not rely solely on a notification for an urgent purchase decision.

9. Content, trade marks and links

• FlyDown's name, logo, mascot, graphics and software belong to its owner.
• The names and logos of the airlines and of FlixBus belong to their respective owners and are used only to identify the service concerned. FlyDown is not affiliated with or endorsed by these companies, unless stated otherwise.
• Destination photos are used in accordance with their licence, with the author credited. The maps use public-domain Natural Earth data.
• Links to third-party websites are provided for convenience: we do not control those websites and are not responsible for their content. If in the future some links are affiliate links, FlyDown will receive a commission at no extra cost to you, and these links will be clearly marked.

10. Service availability

FlyDown is provided "as is". It may be temporarily unavailable due to maintenance or faults, and some features, airlines or data sources may be added, changed or removed. We may also decide to discontinue the service: in that case we will give you at least 30 days' notice, so you can download your data.

11. Liability

To the extent permitted by law, FlyDown is not liable for damage arising from incorrect prices or schedules, deals not reported or reported late, purchase decisions, cancellations, delays or other service failures by airlines, FlixBus or other third parties, or from interruptions of the service.

In any case, this does not affect liability for wilful misconduct or gross negligence and for personal injury, or any rights that the law grants to consumers and that cannot be limited by contract.

12. Deleting your account

You can delete your account whenever you like from your profile, with "Delete account". Your data is erased as described in the privacy notice.

13. Changes to these terms

We may update these terms, for example when we add features or when the law changes. The version in force is always on this page, with the date at the top. Significant changes will be communicated to you in the app before they take effect; if you do not accept them, you can delete your account.

14. Governing law and jurisdiction

These terms are governed by Italian law. If you are a consumer, any dispute falls under the jurisdiction of the courts of the place where you reside, without prejudice to any more favourable protections provided by the law of the European Union country where you live.
